歡迎使用「開口 Pipe Up」（以下稱「本服務」）。本服務由 Pipe Up（個人開發者 Alvin Cheng 經營，以下稱「我們」）提供。你在 App 第一次啟動時按下「同意並開始使用」，即表示你已閱讀並同意本條款與《開口 Pipe Up 隱私權政策》（https://pipeupapp.com/privacy/ ）。開始使用前，你可以在 App 內或 https://pipeupapp.com/terms/ 隨時閱讀全文。不同意請不要使用本服務。

第 1 條　資格

  1. 你必須年滿 18 歲才能使用本服務。使用本服務即表示你聲明並保證你已年滿 18 歲。
  2. 我們發現使用者未滿 18 歲時，得終止其帳號並刪除資料。

第 2 條　服務說明

  1. 本服務是英語口說練習 App。你用語音和 AI 對話夥伴聊天，本服務提供即時語音回應、逐字稿、糾錯建議、中文翻譯、一輪結束後的小結、程度估計、句庫複習，以及記得你聊過的事的「記憶」功能。
  2. 本服務的 AI 功能由第三方 AI 服務（目前為 Google Gemini API）提供。你的語音與對話內容會送到該服務處理，詳見隱私權政策。
  3. 使用本服務需要網路連線、麥克風權限，並以 Sign in with Apple 登入。
  4. 我們可能因改善、維護或第三方服務變動而調整、新增或移除功能。對你有重大不利影響的變更，我們會事先在 App 內通知。
  5. 本服務目前僅於台灣地區的 App Store 提供，不提供臉部辨識，也沒有兒童模式。

第 3 條　AI 內容免責

  1. AI 產生的內容可能不正確。 包括但不限於：糾錯建議、翻譯、文法說明、程度估計（例如「B1」）、小結、AI 對話夥伴說的任何內容，以及語音轉文字的結果，都可能有錯、不完整或不適合你的情境。
  2. AI 內容不是專業意見。 本服務是語言練習工具，不提供醫療、心理、法律、財務、投資或其他專業建議。對話中談到健康、投資等話題時，內容只供練習英文表達，不得作為實際決策依據。
  3. 程度估計只是 AI 對單次練習的粗略判斷，不是正式的語言能力檢定結果，不得用於升學、求職或任何證明用途。
  4. AI 對話夥伴是 AI，不是真人。
  5. 你發現不當、冒犯或有害的 AI 回應時，可以長按那句回應選「回報這句」告訴我們。

第 4 條　帳號

  1. 你應妥善保管你的裝置與帳號，透過你的帳號進行的使用視為你本人的使用。
  2. 發現帳號遭他人使用時，請立即通知我們。
  3. 你可以隨時在 App 內「設定 > 隱私 > 刪除帳號與所有資料」刪除帳號。刪除後資料的處理方式依隱私權政策。

第 5 條　費用與免費額度

  1. 目前免費：本服務目前免費提供，沒有訂閱，也沒有 App 內購買，我們不會向你收取任何費用。
  2. 免費額度：每輪對話最多 5 分鐘，每人每天最多 5 分鐘，每天台灣時間午夜重置。額度用完後，請隔天再來。
  3. 服務容量：為維持服務穩定與控制成本，我們可能在整體使用量達到上限時暫時停止提供對話功能，並在 App 內告知。
  4. 日後推出付費方案：我們日後可能推出付費方案或調整免費額度。屆時會事先在 App 內與本頁公告，付費方案的價格、內容、續訂與取消方式會另外清楚說明，且須經你主動購買才會收費；不會把免費使用自動轉為付費。

第 6 條　使用者行為規範

使用本服務時，你同意不會：

  1. 讓未滿 18 歲的人使用你的帳號或裝置上的本服務；
  2. 輸入或說出違法、騷擾、威脅、仇恨、色情、侵害他人權利的內容，或試圖讓 AI 產生這類內容；
  3. 在對話中提供他人的個人資料（例如他人的姓名搭配電話、地址、證件號碼）或你自己的敏感資料；
  4. 用任何方式繞過、破解或干擾本服務的驗證、額度或安全機制，包括逆向工程、自動化腳本大量呼叫，或以多個帳號規避免費額度；
  5. 把本服務或 AI 產生的內容用於開發競爭的 AI 模型或服務；
  6. 轉售、出租或以其他方式讓第三人有償使用你的帳號；
  7. 違反 Google Gemini API 的使用政策（https://ai.google.dev/gemini-api/terms ）或其他適用法令。

第 7 條　內容與智慧財產權

  1. 你在對話中說的內容，權利仍屬於你。你授權我們在提供本服務所需的範圍內（包括轉寫、送第三方 AI 處理、保存逐字稿與學習紀錄），在隱私權政策所述期間內使用這些內容。
  2. 本服務的軟體、介面、文字與商標，屬於我們或授權人所有。我們授予你個人、非商業、不可轉讓、可撤銷的使用授權，僅限於在你擁有或控制的 Apple 裝置上使用。
  3. 本服務使用的開放原始碼元件，依其各自的授權條款提供。

第 8 條　帳號暫停與終止

  1. 你可以隨時刪除帳號並停止使用。
  2. 你違反本條款、法令或第三方 AI 服務政策，或有濫用、危及服務安全的行為時，我們得視情節通知後暫停或終止你的帳號；情況緊急或法律要求時，得不經通知立即處理。
  3. 我們決定終止本服務時，會至少提前 30 天在 App 內與本網站公告。
  4. 帳號終止後，資料依隱私權政策處理。

第 9 條　免責與責任限制

  1. 本服務依「現狀」免費提供。我們不保證本服務不中斷、無錯誤，或一定能達到特定的學習成效。
  2. 本服務依賴第三方服務（包括 Google 與 Apple）及網路。第三方服務中斷、變更或終止造成的影響，我們會盡力處理，但在法律允許範圍內不負賠償責任。
  3. 我們因故意或重大過失造成的損害，或依消費者保護法等強制規定不得排除或限制的責任，不受前項限制。

第 10 條　條款修改

我們修改本條款時，會在 App 內與本頁公告。重大不利變更會在生效前至少 30 天通知。變更生效後你繼續使用，視為同意；不同意可以停止使用並刪除帳號。

第 11 條　準據法與管轄

  1. 本條款以中華民國（台灣）法律為準據法。
  2. 因本條款或本服務發生爭議，雙方同意以臺灣臺北地方法院為第一審管轄法院。但消費者保護法第四十七條（消費訴訟得由消費關係發生地之法院管轄）、民事訴訟法或其他法律另有規定者，從其規定。

第 12 條　其他

  1. 本條款任一條款無效，不影響其他條款的效力。
  2. 本條款以繁體中文版本為準，英文版本僅供參考。
  3. 你與 Apple 之間關於 App Store 的事項，另適用 Apple 的媒體服務條款。Apple 不是本條款的當事人，對本服務不負維護或支援責任。

Pipe Up Terms of Use

Welcome to 開口 Pipe Up (the "Service"), provided by Pipe Up, run by individual developer Alvin Cheng ("we", "us"). By tapping "Agree and start" when you first open the app, you confirm that you have read and agree to these Terms and to the Pipe Up Privacy Policy (https://pipeupapp.com/privacy/). You can read the full text at any time in the app or at https://pipeupapp.com/terms/ before you start. If you do not agree, do not use the Service.

1. Eligibility

  1. You must be 18 or older to use the Service. By using it you represent that you are.
  2. If we find that a user is under 18, we may terminate the account and delete its data.

2. The Service

  1. The Service is an English speaking practice app. You talk by voice with an AI conversation partner, and the Service provides real-time voice replies, transcripts, correction suggestions, Chinese translations, an end-of-round summary, level estimates, phrase review, and a Memory feature that remembers what you have talked about.
  2. The AI features are provided by a third-party AI service (currently the Google Gemini API). Your voice and conversation are sent to that service for processing; see the Privacy Policy.
  3. The Service requires an internet connection, microphone permission and Sign in with Apple.
  4. We may change, add or remove features to improve or maintain the Service or because a third-party service changes. We will give advance notice in the app of changes that materially disadvantage you.
  5. The Service is currently offered only on the App Store in Taiwan. It does not offer face recognition and has no children's mode.

3. AI content disclaimer

  1. AI-generated content may be wrong. This includes correction suggestions, translations, grammar explanations, level estimates (e.g. "B1"), summaries, anything the AI partner says, and speech-to-text results. They may be inaccurate, incomplete or unsuitable for your situation.
  2. AI content is not professional advice. The Service is a language practice tool and does not provide medical, mental health, legal, financial, investment or other professional advice. When conversations touch on topics such as health or investing, the content is for practising English only and must not be relied on for real decisions.
  3. Level estimates are a rough AI judgement of a single session, not an official language proficiency result, and must not be used for admissions, job applications or any certification.
  4. The AI conversation partner is an AI, not a person.
  5. If you see an inappropriate, offensive or harmful AI reply, long-press it and choose "Report".

4. Your account

  1. Keep your device and account secure; use through your account is treated as your use.
  2. Tell us immediately if someone else is using your account.
  3. You can delete your account at any time under "Settings > 隱私 (Privacy) > 刪除帳號與所有資料 (Delete account and all data)". Data is then handled as described in the Privacy Policy.

5. Fees and free usage

  1. Currently free: the Service is currently provided free of charge, with no subscriptions and no in-app purchases. We do not charge you anything.
  2. Free allowance: each conversation lasts at most 5 minutes, and each person can talk for at most 5 minutes per day. The daily allowance resets at midnight Taiwan time. When it runs out, please come back the next day.
  3. Capacity: to keep the Service stable and costs under control, we may temporarily stop offering conversations when overall usage reaches a limit, and will tell you in the app.
  4. Paid plans in future: we may introduce paid plans or change the free allowance later. We will announce this in advance in the app and on this page; any paid plan's price, content, renewal and cancellation will be explained clearly, and you will only be charged if you actively purchase it. Free use will never convert to paid automatically.

6. Acceptable use

You agree not to:

  1. let anyone under 18 use the Service through your account or device;
  2. say or enter content that is illegal, harassing, threatening, hateful, sexually explicit or infringes others' rights, or try to make the AI produce such content;
  3. share other people's personal data (e.g. someone's name with their phone number, address or ID number) or your own sensitive data in conversations;
  4. bypass, break or interfere with the Service's authentication, quotas or security, including reverse engineering, automated bulk requests, or using multiple accounts to get around the free allowance;
  5. use the Service or its AI output to develop a competing AI model or service;
  6. resell, rent or otherwise give third parties paid access to your account;
  7. violate the Google Gemini API policies (https://ai.google.dev/gemini-api/terms) or any applicable law.

7. Content and intellectual property

  1. You keep your rights in what you say. You grant us permission to use it to the extent needed to provide the Service (including transcription, processing by the third-party AI and storing transcripts and learning records) for the periods described in the Privacy Policy.
  2. The Service's software, interface, text and trademarks belong to us or our licensors. We grant you a personal, non-commercial, non-transferable, revocable licence to use the Service on Apple devices you own or control.
  3. Open-source components are provided under their own licences.

8. Suspension and termination

  1. You may delete your account and stop using the Service at any time.
  2. If you breach these Terms, the law or the third-party AI service's policies, or abuse or endanger the Service, we may suspend or terminate your account after notice, or immediately where urgent or required by law.
  3. If we decide to discontinue the Service, we will announce it in the app and on this website at least 30 days in advance.
  4. After termination, data is handled as described in the Privacy Policy.

9. Disclaimers and limitation of liability

  1. The Service is provided free of charge and "as is". We do not guarantee that it will be uninterrupted or error-free, or that you will reach any particular learning result.
  2. The Service depends on third-party services (including Google and Apple) and the internet. To the extent permitted by law, we are not liable for the effects of their interruption, change or discontinuation, though we will do our best to address them.
  3. Paragraph 2 does not apply to damage caused by our intent or gross negligence, or to liability that cannot be excluded or limited under mandatory law, including Taiwan's Consumer Protection Act.

10. Changes to these Terms

We announce changes in the app and on this page. Material adverse changes are notified at least 30 days before they take effect. If you keep using the Service after a change takes effect, you accept it; if you do not agree, stop using the Service and delete your account.

11. Governing law and jurisdiction

  1. These Terms are governed by the laws of the Republic of China (Taiwan).
  2. The Taiwan Taipei District Court has jurisdiction as the court of first instance, unless the Consumer Protection Act (Article 47: consumer litigation may be brought in the court where the consumer relationship arose), the Code of Civil Procedure or other law provides otherwise.

12. Miscellaneous

  1. If any provision is invalid, the rest remain in effect.
  2. The Traditional Chinese version of these Terms prevails; this English version is for reference.
  3. Matters between you and Apple regarding the App Store are also governed by Apple's Media Services Terms. Apple is not a party to these Terms and has no obligation to maintain or support the Service.
